Terms of Service
Effective October 29, 2026
These terms are an agreement between you, the business signing up ("you"), and MY PC STAFF CORP, a Florida corporation doing business as Callonia ("Callonia", "we", "us"). By creating an account, paying a setup fee or using the service, you agree to these terms and to our Privacy Policy. Callonia is for business use only.
1. The service
Callonia answers your business’s phone calls with an AI assistant that can answer questions, take orders, take card payments through your own Stripe account, request delivery drivers from third-party couriers, book reservations, take messages and transfer calls to your staff. You get a kitchen screen and, depending on your plan, an owner dashboard. Features available to you depend on your plan.
2. Your account
You must give us accurate information, keep your login details secure and make sure everyone who uses your account follows these terms. You are responsible for activity in your account. Tell us right away at hello@callonia.ai if you think your account has been accessed without permission.
3. Fees and billing
- Setup fee: a one-time fee, charged before we start setting up your service.
- Monthly plan: billed in advance each month starting on the day your service goes live.
- Included minutes: each plan includes a number of call minutes per month. Unused minutes do not roll over.
- Extra minutes: minutes above your plan are billed at the end of the month at your plan’s rate. We alert you at 80% and 100% of your included minutes, and you can set a spending cap in your dashboard.
- Taxes: prices do not include taxes, which are added where required.
- Payment: fees are charged to the payment method on file through Stripe. If a payment fails, we will let you know and retry. If it is not resolved within 14 days, we may pause the service until it is.
- Price changes: we will give you at least 30 days’ notice by email before changing your plan’s price.
4. Cancellation and refunds
Plans are month to month. You can cancel anytime from your dashboard or by emailing us. Cancellation takes effect at the end of your current billing month, and we do not refund partial months.
The setup fee is not refundable once setup work has started, with one exception: if we cannot get your service working for reasons within our control, we will refund the full setup fee.
We may suspend or end your service if you seriously or repeatedly break these terms, after giving you notice and a chance to fix the problem when that is reasonable.
5. Payments from your customers
Card payments taken during calls are processed by Stripe through a Stripe account in your business’s name. You are the merchant of record for your sales and must accept Stripe’s terms. Stripe’s processing fees, refunds to your customers and chargebacks are your responsibility. Callonia never holds your sales money; Stripe pays it to your bank account.
For delivery orders, Callonia may collect the courier’s fee from the order through Stripe and pay the courier on your behalf.
6. Delivery
Deliveries are performed by independent third-party couriers such as Uber Direct and DoorDash Drive, not by Callonia. The customer pays a delivery fee starting at $4.99, quoted during the call. Your business covers up to $3 of the courier’s cost per delivery, or the amount set in your settings, and any amount above that is added to the customer’s delivery fee. Courier service, timing and issues such as late or damaged deliveries are subject to the courier’s own policies. We will help you contact the courier when something goes wrong.
7. Your responsibilities
- Keep your menu, prices, hours, delivery area, allergen information and promotions accurate and up to date. The AI answers based on what you give us.
- Prepare, package and hand over orders, and handle food safety, quality and customer service for your business.
- Follow the laws that apply to your business, including food safety, sales tax, consumer protection and laws about calls and recordings.
- Keep the call notice turned on so callers know calls are transcribed and may be recorded.
- Not use Callonia for unlawful, misleading or harmful purposes, to make unsolicited calls, or to collect sensitive information it was not designed for.
8. AI limitations
Callonia uses artificial intelligence, which can occasionally misunderstand a caller or make a mistake. Orders show on your kitchen screen so your staff can review them. Questions about allergies or health should be confirmed with the customer by your staff before preparing the order. Callonia is not responsible for losses caused by an order error beyond the credit described in section 11.
9. Your data
You own your business data, including your menu, orders and customer information. You give us permission to use it only to provide, secure and improve the service for you, as described in our Privacy Policy. We do not sell your data or use it to train AI models. When you cancel, you can export your data for 30 days, after which we delete it except records we must keep by law.
10. Service availability and support
We work to keep Callonia available at all times, but we do not guarantee it will be uninterrupted or error free. Phone, internet and third-party providers can have outages. When possible, calls are forwarded to your restaurant line if Callonia cannot answer. Support is available by email at hello@callonia.ai, and we will tell you in advance about planned maintenance.
11. Credits for service problems
If Callonia is unable to answer your calls for more than 24 hours in a month because of a problem on our side, we will credit you a share of that month’s plan fee proportional to the time the service was down, on request.
12. Intellectual property
Callonia, its software, voices, designs and content belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the service while your account is active. If you send us suggestions, we may use them without obligation to you.
13. Third-party services
The service relies on third parties such as Twilio, Anthropic, Stripe, Uber Direct, DoorDash and Cloudflare. Their services are subject to their own terms, and we are not responsible for their acts or failures beyond our own obligations in these terms.
14. Disclaimer
Except as stated in these terms, the service is provided "as is" and "as available", and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.
15. Limitation of liability
To the extent the law allows, neither party is liable to the other for lost profits, lost revenue or indirect, incidental, special or consequential damages. Our total liability for any claims related to the service is limited to the amount you paid us in the 12 months before the claim. These limits do not apply to your payment obligations or to either party’s fraud or willful misconduct.
16. Indemnity
You agree to defend and hold us harmless from third-party claims arising from your food, products or services, your menu and allergen information, your violation of law, or your breach of these terms.
17. Governing law
These terms are governed by the laws of the State of Florida. Any dispute will be handled in the state or federal courts located in Pinellas County, Florida, and both parties agree to those courts’ jurisdiction. Before going to court, we both agree to try to resolve the dispute informally by email for 30 days.
18. Changes to these terms
We may update these terms. If a change is material, we will email you at least 30 days before it takes effect. If you do not agree, you can cancel before the change applies.
19. General
These terms and the Privacy Policy are the entire agreement between us about the service. If any part is found unenforceable, the rest remains in effect. You may not transfer your account without our consent. Notices to you will be sent to your account email; notices to us go to hello@callonia.ai.
